The global contest over artificial intelligence is often framed as a regulatory problem, but it is better understood as a contest over economic gravity, capital allocation, and institutional confidence, in which law functions less as a moral compass than as a force multiplier or a drag coefficient depending on how early and how rigidly it is applied.
The European Union’s experience is instructive not because it is uniquely cautious, but because it illustrates a familiar pattern: comprehensive regulation arrived before market structure stabilized, followed by visible concern about competitive slippage, capital flight, and strategic dependency, and then by quiet recalibration once those risks became measurable rather than hypothetical. The formal language of safety and trust remained intact, but the timetable softened, scope narrowed, and enforcement posture shifted, all in service of a more basic concern about losing ground in a domain where first-mover advantage compounds quickly and reversals are rare.
What tends to go unspoken in these debates is that capital, not regulators, arbitrates the pace and geography of AI development, and capital is exquisitely sensitive to friction at the point of model training rather than downstream deployment, because training decisions relocate first, quietly and often permanently. Once compute, data pipelines, and talent clusters move, they rarely return for reasons of legal coherence alone.
The United States has understood this instinctively, even while publicly wrestling with the risks of advanced systems. Its regulatory posture has oscillated between executive caution and legislative hesitation, not because harms are ignored, but because there is broad awareness that premature certainty carries geopolitical cost. China, operating under a different governance model altogether, has been even clearer that AI capability is a matter of national power, not merely consumer protection. In that context, countries that regulate ahead of both superpowers do not become ethical leaders; they risk becoming rule-takers in a technology they no longer meaningfully shape.
Canada occupies an unusual position in this landscape. It is not a superpower, but it is also not a regulatory bystander. It has deep AI research roots, a credible talent base, and integration into U.S. capital and supply chains, while retaining sufficient policy autonomy to choose timing rather than merely content. That combination matters. National power in AI does not come from passing the first statute; it comes from deciding when constraint strengthens leverage rather than dissipates it.
Much of the critique directed at Canada’s lack of a comprehensive AI Act rests on the language of regulatory gaps, uneven protection, and legal uncertainty. Those concerns are not frivolous, but they often mistake calibration for absence. Canadian law already governs harm, discrimination, misrepresentation, negligence, privacy, and unfair practices through technology-neutral doctrines that have long absorbed latent and systemic risks without demanding ex ante intelligibility. The fact that algorithmic bias may be difficult to detect does not distinguish AI from other complex decision systems the law has historically addressed after impact rather than before design.
The pressure to legislate comprehensively is frequently driven less by demonstrated enforcement failure than by discomfort with opacity. Yet opacity is not a regulatory anomaly. Financial models, credit scoring systems, actuarial tools, and even discretionary administrative decision-making have operated for decades without full transparency, policed instead through reasonableness, justification, and consequence. The insistence that AI must be fully explainable to be governable risks confusing epistemic unease with legal deficiency, while offering the appearance of control rather than its substance.
This matters geopolitically because comprehensive AI statutes tend to regulate by category and form rather than by conduct and context, and in doing so they privilege scale, incumbency, and compliance infrastructure. The resulting equilibrium favours large, already-capitalized actors and disincentivizes domestic experimentation, particularly in smaller economies. For a country like Canada, whose competitive advantage lies in talent formation, research translation, and integration rather than sheer market size, that trade-off is not neutral.
Countries that impose comprehensive constraints before domestic capacity has scaled often discover that they have not reduced risk so much as relocated it, becoming dependent on foreign platforms, foreign models, and foreign contractual terms, while retaining responsibility for enforcement without meaningful influence over design.
Canada does not face a choice between competitiveness and safety here. It faces a choice between horizontal constraint and targeted obligation. Existing privacy law has already demonstrated its capacity to reach harmful AI practices without bespoke legislation, and professional responsibility regimes have addressed misuse without recasting tools as autonomous legal actors. Strengthening enforcement, institutional capacity, and narrowly scoped duties for high-risk deployments is a different exercise from freezing an entire sector under a generalized precautionary regime.
What is often described as legal uncertainty for institutions is, more precisely, the absence of statutory safe harbours. That absence is uncomfortable, but it also preserves adaptive judgment at a moment when global norms remain unsettled. Premature certainty may soothe internal risk committees, but it can just as easily lock a country into assumptions that its competitors are free to revise.
National power in AI will not be determined by who legislates first, but by who retains the capacity to shape standards once technical trajectories harden and dependencies emerge.
